This Agreement contains important information about your rights and obligations. Please read it carefully and keep it for your records.

1. DEFINITIONS AND INTERPRETATION

Key Terms

"Account"
means your Optimum Store Card account established under this Agreement
"Card"
means any Optimum Store Card, including physical and digital cards, issued to you
"Merchant"
means any participating retailer authorized to accept the Card
"We," "Us," "Our"
means Optimum Financial Services LLC and its affiliates

2. ACCOUNT OPENING AND CARD ISSUANCE

2.1 Eligibility Requirements

  • Must be at least 18 years of age (19 in Alabama and Nebraska)
  • Must have a valid Social Security Number or Individual Taxpayer Identification Number
  • Must have a verifiable U.S. address (P.O. Boxes not accepted for primary address)
  • Must meet our creditworthiness standards as determined by our underwriting criteria
  • Must not be subject to any legal restrictions preventing credit extension

2.2 Application Process

By submitting an application, you authorize us to obtain credit reports and verify information provided. You certify that all information is accurate and complete. Providing false information may result in application denial and potential legal action.

2.3 Card Activation and Security

  • Cards must be activated before first use through our secure activation system
  • You must sign the card immediately upon receipt
  • Cards remain our property and must be returned upon request
  • We may issue replacement cards with new account numbers at our discretion

3. CREDIT TERMS AND CONDITIONS

3.1 Credit Limit

Your initial credit limit will be communicated upon account approval. We may increase or decrease your credit limit at any time based on account performance, creditworthiness, and business considerations. Credit limit increases may be subject to additional terms and conditions.

3.2 Interest Rates and Promotional Offers

0% APR Forever Benefit

Your Optimum Store Card features 0% Annual Percentage Rate (APR) on all purchases with no expiration date, subject to account remaining in good standing.

Good Standing Requirements: Account must be current with no payments more than 30 days past due in the preceding 12 months, and account must not exceed credit limit.

4. ACCOUNT USAGE AND RESTRICTIONS

4.1 Authorized Use

  • Card may only be used at participating Optimum partner merchants
  • Card cannot be used for cash advances, money orders, or cash-equivalent transactions
  • International transactions are not permitted
  • Online purchases limited to participating merchant websites
  • Business cards may have additional usage restrictions based on merchant category codes

4.2 Liability for Unauthorized Use

You are liable for all transactions made with your Card until you notify us of loss, theft, or unauthorized use. Your maximum liability for unauthorized use is $50, provided you notify us within 60 days of the statement date on which the unauthorized transaction appears.

4.3 Transaction Disputes

You must notify us in writing within 60 days of the statement date for any billing errors or unauthorized transactions. We will investigate and respond within the timeframes required by applicable law.

5. PAYMENT TERMS

5.1 Minimum Payment Requirements

Your minimum payment is the greater of: (a) $25, or (b) 2% of your statement balance. Payments are due by 5:00 PM ET on the payment due date shown on your statement.

5.2 Payment Methods and Processing

  • Online payments through our secure website or mobile app
  • Automatic payments from your bank account (ACH)
  • Phone payments through our automated system or customer service
  • Mail payments to the address shown on your statement
  • In-person payments at participating merchant locations

6. DEFAULT AND REMEDIES

6.1 Events of Default

You will be in default if any of the following occur:

  • Failure to make minimum payment within 30 days of due date
  • Exceeding your credit limit by more than $100 for more than 30 days
  • Providing materially false information on your application or to us
  • Filing for bankruptcy or making an assignment for the benefit of creditors
  • Death or legal incapacity (for individual accounts)
  • Breach of any other term of this Agreement

6.2 Consequences of Default

Upon default, we may: (a) declare the entire balance immediately due and payable, (b) close your account, (c) report the default to credit bureaus, (d) pursue collection activities, and (e) exercise any other rights available at law or equity.

7. DISPUTE RESOLUTION

7.1 Binding Arbitration

IMPORTANT: This section contains a binding arbitration provision that affects your rights. Please read it carefully.

Any claim or dispute between you and us will be resolved by binding arbitration rather than in court, except for small claims court matters under $5,000 and certain injunctive relief.

You may opt out of arbitration by sending written notice within 60 days of account opening to: Optimum Financial Services, Arbitration Opt-Out, P.O. Box 12345, New York, NY 10001.

7.2 Class Action Waiver

You agree that any arbitration will be conducted on an individual basis and not as part of a class, collective, or representative action.

8. PRIVACY AND DATA PROTECTION

8.1 Information Collection and Use

We collect, use, and share your personal information as described in our Privacy Policy. By using your Card, you consent to our information practices as outlined in the Privacy Policy.

8.2 Credit Reporting

We may report information about your account to credit bureaus. Late payments, missed payments, or other defaults may be reflected in your credit report and may impact your credit score.

9. GENERAL PROVISIONS

9.1 Changes to Agreement

We may change any term of this Agreement at any time. We will provide at least 45 days advance written notice of material changes. Your continued use of the Card after the effective date constitutes acceptance of the changes.

9.2 Governing Law

This Agreement is governed by federal law and the laws of the State of Delaware, without regard to conflict of law principles.

9.3 Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions will continue in full force and effect.
